Title VI Compliance with the Civil Rights Act
Section IV of ASAP Policies & Procedures
A. Candidates for employment will be considered without regard to race, age, religion, national origin, political or union affiliation, marital status, or sex. No qualified handicapped person shall, on the basis of handicap, be subjected to discrimination in employment.
“Handicapped persons” means any person who (1) has a physical or mental impairment which substantially limits one or more major life activities, (2) have a record of such impairment, or (3) is regarded as having such impairment.
“Physical or mental impairment” means (a) any physiological disorder or condition, cosmetic disfigurement, or anatomical loss affecting one or more of the following body systems; Neurological; musculoskeletal; special sense organs, respiratory (including speech) organs; cardiovascular; reproductive, digestive; genitourinary; hemic and lymphatic; skin; and endocrine; or (b) any mental or psychological disorder such as mental retardation, organic brain syndrome, emotional or mental illness, and specific learning disabilities.
“Major life activities” include functions such as caring for one’s self, performing manual tasks, walking, seeing, hearing, speaking, breathing, and working.
B. A complaint alleging discrimination may be filed by an individual as an internal complaint or as an external complaint. Complaints must be filed with either the Executive Director OR Board of Directors or with the state Title VI coordinator within 30 days of the alleged discrimination. Complaints shall be investigated by an appropriate party who will provide a report of findings to the Board of Directors within thirty days. Any appeal by a complainant must be submitted within ten calendar days. If a hearing is deemed necessary, the Board of Directors will arrange for due process within 30 days.
C. Employees shall receive Title VI training annually, as specified by grant contracts. This training will be facilitated by the Executive Director in compliance with contract requirements.
D. Limited English Proficiency (LEP) Procedure: Limited English proficient community members shall be provided equal access to coalition services. To ensure access and equal services, provisions for services are monitored by the coalition staff, coalition members, and the Executive Board. In the event it is determined translation services are necessary, ASAP will coordinate with proper entities to ensure this service is provided.
